Shipping & Delivery (Within the UK)
We endevour to deliver all orders a next day basis where possible. If the delivery period will be over 48 hours from order placement this will be notified upon your order being received. Deliveries within the UK are completed by our fleet of delivery  vehicles or via a third party courier service (APC Network).  Deliveries are tracked electronically through to completion.

Payment
We accept the following methods of payment: 

1. Credit Card
Online credit card payment can be made for any purchase from this website for delivery for deivery within the UK. If you would like to pay via credit card  but require delivery outside of the UK please contact us on +44 (0)1454 338985 or sales@phoenixse.com.  Credit card details are not recorded or kept on our servers.

2. Direct Bank Transfer (BACS, CHAPS or IBAN)
Bank transfer is the preferred method for larger transactions.  Goods are dispatched once the funds are received into our account.  Our bank details are available on request.  Bank Transfer (IBAN) Payments are the preferred payment method for large orders received from outside the UK.

3. Postal Cheque
Please Note; We only accept cheque payment for transactions within the UK.  Cheques should be in UK Sterling (GBP) and made out to 'Phoenix Surveying Equipment Ltd'.  Goods are dispatched upon clearance of the cheque.

4. PayPal
We accept payments from PayPal below £1,000.00.  If you would like to pay via Paypal please contact us on +44 (0)1454 338985 or sales@phoenixse.com.

5. Credit Account

Tax
VAT will be charged at 17.5% for all orders within the European Union (including the UK).  From 01/01/2011 VAT will be applied at 20%.  All orders delivered outside of the EU are VAT exempt.

Returns & Replacements
Buyer must notify seller within 3 days after receiving the item of any problems that may require a return and/or refund. UPON SELLERS APPROVAL items may be returned to the seller AT BUYERS EXPENSE. The item will then be tested to determine condition. If the item is not working properly and no signs of physical damage are visible, payment for the item will be refunded. Software, once registered, is non-refundable.  Seller reserves the right to replace, repair or issue a refund for the purchase price of any item. Items returned to seller that do not meet the above criteria, refunds will not be honoured.  In the case of non-stock special order items, a handling fee of up to 25% may be applied.

Pricing
All prices shown on this website are plus VAT and delivery (where applicable) and are subject to amendment at any time should Phoenix Surveying Equipment Ltd deem it necessary to do so. In the case of pricing errors or inaccuracy regarding goods listed on this site Phoenix Surveying Equipment Ltd reserves the right to withdraw from any contract.

Promotions
Promotional offers on the this website are subject to withdrawl at any time and without prior notice.  Only one promotional offer may be applied to any singular order unless otherwise agreed in writing with the seller.

Terms and Conditions - Phoenix Surveying Equipment Ltd

Conditions of Sale

1.No property in the goods shall pass until the purchase price and any interest due has been paid in full and the buyer shell have custody of the equipment as agent and bailee of the seller only but shall be responsible for all loss, destruction or damage there to, and shall store the goods in such a manner as to indicate clearly that the property remains vested in the seller.

2.If the purchase price shall not be paid in full with 30 days of the date hereof the seller may at anytime thereafter require the buyer forthwith to return the equipment but if the buyer does not immediately return the equipment the seller shall be entitled to recover it from the buyer and charge the buyer the cost of so doing, and the buyer hereby grants a licence to the seller to enter upon the premises of the buyer to effect such a recovery.

3.The buyer having inspected the equipment, it is agreed that the equipment is suitable for the buyer’s purposes and that the seller shall not be responsible for any defect in the equipment except insofar as the seller has itself received any assignable guarantee in which case such guarantee will on request be assigned by the seller to the buyer.

4.Interest shall be payable on the whole or any part of the purchase outstanding if it has not been paid in full within 30 days after it becomes due, such interest to be charged at a rate of 20% per annum on sums outstanding from the date hereof until the date of payment in full, interest to be calculated on a daily basis.

5.Customer owned equipment held by Phoenix Surveying Equipment Ltd shall be held securely for the duration of any necessary quotation, service and repair work.  After the required work has been completed Phoenix Surveying Equipment Ltd will make every reasonable effort to contact the owner for a 3 month period.  Should this period lapse without confirmed contact and instruction from the owner, Phoenix Surveying Equipment Ltd reserve the right to dispose of customer owned equipment at their discretion. 


Conditions of Hire


"The Owner" is Phoenix Surveying Equipment Ltd.
"Hirer" is the party named on the hire documents

Payment

1.The hire charge accrues on a daily basis from the date of despatch until the date upon which the equipment returns to the owner.

2.Unpaid hire charges and any other sums due hereunder incur interest at the rate of 20% per annum (calculated on a daily basis) from the date of payment whether before or after judgment.

3.In those instances where an initial cash hire is paid by credit card and the hire transaction extends into a continuous hire then the Owner reserves the right to charge the credit card with any unpaid charges arising there from on a weekly basis.  The Hirer will be informed by the Owner of such charges as and when they are incurred.

Hirer's Responsibilities

1.Every possible effort has been made to ensure that the equipment is serviceable and suitable but the hirer must satisfy himself of this before the start of the hire and the owner is not liable in any defects, failure or inaccuracies in the equipment.

2.The hirer shall keep the equipment in good repair and condition and on termination of the hire shall return the equipment in the same state of repair and condition as it was at the start of the hire, failing which the hirer shall be liable to the owner for any loss or damages and costs suffered directly or indirectly by the owner as a result.

3.The hirer shall use the equipment in Great Britain (not Northern Ireland) only and shall not permit it to be used elsewhere.

4.The hirer shall use the equipment for its proper purpose only an shall not hire let or otherwise part with possession of it.

5.The hirer shall insure the equipment in its full replacement value against all risks of a comprehensive policy.

6.If the equipment is lost stolen or damaged beyond economic repair the hirer must pay on demand the current retail price as published.

7.Until payment in full is received for losses or damage the owner reserves the right to continue any hire charges until payment is received in full. Hire charges are calculated on weekly basis.

Termination

1.The hiring shall terminate and the hirer shall forthwith return the equipment to the owner if:- 

a.The agreed term of the hire expires, or

b.Any payment due from the hirer remains unpaid 30 days from the earlier of the date due or the relevant invoice, or

c.If the hirer is an individual partnership, on an act of insolvency, or

d.If the hirer is a limited company on the appointment of a Receiver or on the entering of any judgment against the company or on the initiation of winding up proceedings (whether by resolution, notice, petition or otherwise) or in any arrangement being made with creditors or

e.On the hirer giving the owner 7 days written notice of termination.

2.On termination if the hirer does not immediately return the equipment, the owner shall be entitled to recover it, from the hirer and charge the hirer the cost of so doing and the hirer hereby grants a licence to the owner to enter the premises of the hirer to effect such recovery.
